Trust and Probate Litigation
Sometimes a dispute develops over the drafting or execution of a will or trust, or its meaning. The dispute that can sometimes ensue is sometimes called a "contest". Often this focuses on issues such as "incapacity", "undue influence" or "fraud".
Frequently, there can be an interpretation issue, over the meaning of a phrase in a will or trust, of its effect on the heirs or beneficiaries.
Also quite frequently, issues arise over accountings rendered by the executor of a will, or the trustee of the trust, who has a fiduciary duty to render accountings at certain intervals, or the fiduciaries failure to account.
